I would like to draw your attention to a series of documents that have been released to the media relating to the nearly Rs 1 lakh Crore Spectrum scam involving the Union Minister for Telecommunications, Mr. A Raja of the DMK party. In brief, the documents are as follows:

  1. DO letter No. 007/P&T/095-25398 dated 15.11.2008 from
    Mr. K.S. Ramasubban, Secretary, Central Vigilance Commission, to
    Mr. Siddhartha Bohura, Secretary, Department of Telecom, indicating that all was not well with regard to the Spectrum allocation policy of the Telecom Ministry and intimating the CVC’s displeasure over the reply furnished by the Department to certain specific queries raised by the CVC.

  2. Extract of notings made by the Ministry of Law & Justice in which the Law Secretary notes on November 1, 2007, that the issues relating to the grant of Spectrum required further refinement. To this, the Union minister for Law & Justice has observed in his own handwriting:
    "I agree. In view of the importance of the case and various options indicated in the statement of the case, it is necessary that the whole issue is first considered by an empowered group of ministers…"

  3. DO letter No. 20-100/2007-AS.I dated November 2, 2007 from Union Telecom Minister Mr. Raja to the Prime Minister of India that the objections of the Minister of Law & Justice notwithstanding, he intended to continue with the controversial policy of "first-come-first-served" for the allocation of Spectrum.
  4. A letter dated November 2, 2007 (the same day as Mr Raja’s letter) from the Prime Minister of India drawing attention to the issues raised in the media on the allocation of Spectrum and stressing on the need to ensure fairness and transparency. The letter also insists that the Prime Minister should be kept informed before any further action is taken in this regard.
  5. DO letter No. 260/M(C&IT)/VIP/2007 dated December 26, 2007 (54 days later), from Mr. Raja, informing the PM that he had consulted with the External Affairs Minister and the Solicitor General of India. He dismisses a case filed by the Cellular Operators Association of India as "frivolous and vexatious court proceedings" and informs that he had already decided on how to proceed with the allocation of spectrum. He also indicates that his stand conforms to the position of the Telecom Regulatory Authority of India (TRAI).
  6. File notings dated 25.10.2007 by senior officials of TRAI that "first-come-first served criteria would be replaced by entry by bidding…" The notings also insist that spectrum may be allocated "based on auctions".

These documents clearly indicate that the Union Law Minister had reservations about the "first-come-first-served" policy for spectrum allocation advocated by Mr. Raja. They also indicate that the Prime Minister himself was unhappy about the process and advised caution and transparency. Further, the TRAI had also suggested that the policy be abandoned and the more appropriate system of auctions be adopted. Yet Mr Raja had gone ahead with a first-come-first-served sale of Spectrum licences.


It has become more than apparent that "letter-pad" organizations like Unitech and Swan Telecom had bought Spectrum licences at
throw-away prices, improved their brand-equity and sold stakes in their companies to foreign entities for astronomical sums. If the Telecom Ministry had gone in for an international bidding, these very same players would have paid the same astronomical amounts to the Government of India. By willfully opting for a faulty policy, Mr Raja has caused huge loss to the Government and the Indian Nation. Since he did so, over-ruling objections from several quarters, it is apparent that he had a vested interest in ensuring that a free and fair bidding procedure was not followed.


The Central Vigilance Commission had smelt a rat and referred the issue for investigation to the Central Bureau of Investigation. The CBI has conducted raids in offices of the Telecom Ministry. My information is that substantial incriminating documents have been unearthed. The interest of justice will not be served if at this stage Mr. Raja continues to preside over the Telecom Ministry. He is in a position to tamper with evidence and influence officials who are in the know of things.


In view of this, the Prime Minister should have Mr Raja divested of the Telecom portfolio immediately. Further, necessary orders have to be passed to widen the scope of the investigation so that it does not stop merely with the wrong policy adopted for allocation of Spectrum but also covers the beneficiaries of this Rs 1 lakh crore scam.


The share holders of controversial companies like Swan and Unitech have to be interrogated. The truth behind Tiger Holdings, Peacock, Genex Exim and other mysterious hands behind these "letter pad" organizations has to be made public. It is widely believed that the money amassed by Mr. Raja through his Spectrum allocations has been diverted to foreign accounts of Tamil Nadu Chief Minister M. Karunanidhi, his daughter and Member of Parliament, Kanimozhi and several of their family members in addition to some business ventures floated by close family members of Mr. Raja. It is also widely believed that this transfer of money abroad took place through the hawala route in total violation of Indian laws. There is also reason to believe that the ETA Group based in the Middle East, which has close business connections with Mr. Karunanidhi and his family since the late 1960s, and which has made its entry into the Spectrum deal in the guise of Genex Exim, a 9% share holder in Swan Telecom, is the conduit through which huge sums of money were illegally spirited abroad.


Mr. Prime Minister, all these truths have to come out if the interest of justice is to be served. Or else the people will begin to lose faith in the System. And that would be a sad day for Indian democracy.
